Het college kan ontheffing verlenen van het verbod als bedoeld in het eerste lid. 4. Onverminderd het bepaalde in artikel 1:8 kan de ontheffing worden geweigerd in het belang van: de bescherming van natuur en landschap; de bescherming van een dorps- of stadsgezicht. 5. Op de ontheffing is paragraaf 4.1.3.3 van de Algemene wet bestuursrecht (positieve fictieve beschikking bij niet tijdig beslissen) niet van toepassing.»
