Sleeping in a motorhome in Austria

The three legal facts are distinct: parking, sleeping inside and camping. The mistake that costs money is assuming that the second follows from the first.

YES, WITH LIMITS — No general hour limit. But PARKING is prohibited from 22:00 to 06:00 (and during the Fahrverbot of § 42 Abs. 1) within the Ortsgebiet less than 25 m from buildings used exclusively or mainly as dwellings, hospitals, spas or care homes for the elderly, for lorries, Spezialkraftwagen, trailers and tractor units each exceeding 3.5 t MAM. For buses the threshold is 7.5 t (lit. i).
  • The Austrian threshold is 3.5 t, not 7.5 t as in Germany: that is the difference that gets fined. Motorhomes are usually registered as 'Spezialkraftwagen' under the Austrian KFG, a category expressly cited in lit. f, so that a motorhome over 3.5 t falls within the 25 m night-time ban -- that specific classification could NOT be verified in an official source and must be confirmed before publishing. In addition: on pavements with road markings authorising parking, only vehicles of up to 3,500 kg (§ 23 Abs. 2); in Wohnstrassen and Begegnungszonen only in marked bays (§ 23 Abs. 2a); trailers without a towing vehicle only during loading/unloading (§ 23 Abs. 6). LENGTH is never a criterion. Parking is legal, but SLEEPING OVERNIGHT inside is 'Kampieren' under § 2 lit. a of the Tiroler Campinggesetz 2001 ('das Naechtigen von Personen in mobilen Unterkuenften, wie Zelten, Wohnwaegen, Kraftfahrzeugen, Wohnmobilen...') and is prohibited outside campsites unless a municipal Verordnung under § 3 Abs. 6 provides otherwise.

«§ 24 Abs. 3: Das Parken ist ausser in den im Abs. 1 angefuehrten Faellen noch verboten: [...] f) in der Zeit des Fahrverbotes gemaess § 42 Abs. 1 sowie sonst von 22 Uhr bis 6 Uhr im Ortsgebiet weniger als 25 m von Haeusern entfernt, die ausschliesslich oder vorwiegend Wohnzwecken dienen oder die Krankenanstalten, Kuranstalten oder Altersheime sind, mit Lastkraftwagen, Spezialkraftwagen, Anhaengern und Sattelzugfahrzeugen mit einem hoechsten zulaessigen Gesamtgewicht von jeweils mehr als 3,5 t. || Tiroler Campinggesetz 2001 § 3 Abs. 1: Das Kampieren ausserhalb von Campingplaetzen ist verboten, ausgenommen auf Grundflaechen, fuer die eine Verordnung nach Abs. 6 erlassen worden ist.»
