Onverminderd het bepaalde in artikel 1.8 kan de ontheffing worden geweigerd in het belang van: a. bescherming van natuur en landschap; of b. bescherming van het dorpsgezicht; c. voorkoming van overlast of gevaarlijke situaties. Op de ontheffing is paragraaf 4.1.3.3. van de Algemene wet bestuursrecht (positieve fictieve beschikking bij niet tijdig beslissing) niet van toepassing.»
