Het college kan ontheffing verlenen van het verbod. 5. Onverminderd het bepaalde in artikel 1:8 kan de ontheffing worden geweigerd in het belang van de bescherming van: natuur en landschap; of het uiterlijk aanzien van de gemeente. 6. Op de aanvraag om een ontheffing is paragraaf 4.1.3.3 van de Algemene wet bestuursrecht (positieve fictieve beschikking bij niet tijdig beslissen) niet van toepassing.»
