- El art. 18, parrafo 1, de la ZJRM-2 tipifica la pernocta, pero no con caracter absoluto: castiga a quien pernocta en un lugar publico o en otros espacios accesibles que no esten destinados a ello Y con esa conducta inquieta a alguien. Los dos requisitos son cumulativos, de modo que la pernocta discreta que no molesta a nadie no colma el tipo.
- El art. 2, punto 2, de la ZJRM-2 define lugar publico como todo espacio accesible a cualquiera de forma incondicionada o bajo ciertas condiciones, excluido el ciberespacio; el punto 3 define espacio privado como el de propiedad o posesion privada al que solo se accede con el consentimiento del titular.
- El art. 18, parrafo 2, remite expresamente al municipio: las comunidades locales autonomas pueden fijar por sus propias normas las condiciones, las areas y el regimen de la pernocta EN VEHICULOS en su territorio.
