Sleeping in a motorhome in Scotland
The three legal facts are distinct: parking, sleeping inside and camping. The mistake that costs money is assuming that the second follows from the first.

- El derecho estatutario de acceso (right to roam) NO ampara estar en el terreno ni cruzarlo «in or with a motorised vehicle or vessel»: la autocaravana y la camper quedan fuera del art. 9(f).
- Unica excepcion literal del art. 9(f): vehiculo construido o adaptado para una persona con discapacidad y usado por esa persona.
- Al no haber permiso estatal para el vehiculo, dormir dentro depende del permiso del propietario del terreno, de las byelaws locales y de las reglas de estacionamiento de la via: cada una es una regla aparte con su propia cita.

IT DEPENDS — Sin limite nacional de tiempo en via publica: lo fijan los Traffic Regulation Orders del municipio. Limite fisico nacional (RTA 1988 s.34(3)): salir de la calzada hacia el terreno solo esta amparado hasta quince yardas (13,7 m) y unicamente con el fin de aparcar; mas alla de esa franja, conducir sobre el terreno ya es delito. Y esa franja NO es un permiso de estacionamiento: s.34(5) declara que nada en el articulo confiere derecho a aparcar en terreno alguno ni afecta a la ley de allanamiento (trespass) ni a las byelaws.
- RTA 1988 s.34(5): las quince yardas del s.34(3) son solo una defensa frente al delito de conducir fuera de la calzada, no un derecho de estacionamiento. El propio articulo declara que nada en el confiere derecho a aparcar en terreno alguno, ni desplaza las byelaws aplicables al terreno ni la ley de allanamiento: sobre suelo privado sigue haciendo falta permiso del propietario.
- RTA 1988 ss.19 and 20 also apply in Scotland (extent E+W+S): it is prohibited to park a goods vehicle with an operating weight over 7.5 t on the verge, central reservation or footway. There is no national rule based on length or on 3,500 kg. The Scottish key point: the right of access (right to roam) does NOT cover motor vehicles - Land Reform (Scotland) Act 2003 s.9(f) excludes from access rights "being on or crossing land in or with a motorised vehicle", except a vehicle adapted for and used by a person with a disability. In other words, wild camping on foot is legal, but taking the motorhome onto the land is not: the landowner's permission is required.

«(3) It is not an offence under this section to drive a mechanically propelled vehicle on any land within fifteen yards of a road, being a road on which a motor vehicle may lawfully be driven, for the purpose only of parking the vehicle on that land. (4) A person shall not be convicted of an offence under this section with respect to a vehicle if he proves to the satisfaction of the court that it was driven in contravention of this section for the purpose of saving life or extinguishing fire or meeting any other like emergency. (5) It is hereby declared that nothing in this section prejudices the operation of— (a) section 193 of the M2 Law of Property Act 1925 (rights of the public over commons and waste lands), or (b) any byelaws applying to any land, or affects the law of trespass to land or any right or remedy to which a person may by law be entitled in respect of any such trespass or in particular confers a right to park a vehicle on any land.»

- Lo que castiga la norma es acampar SIN el consentimiento del propietario o del ocupante legal: «without the consent and permission of the owner or legal occupier». Con permiso del dueño no hay delito. Es una prohibición por defecto, no absoluta.
- No hay franja de vía pública que salve: el art. 3(1) castiga acampar tanto «on any land, being private property» como «on or near any road», y en ambos casos exige el consentimiento del titular.
- La excepción del art. 3(2) —quedar amparado por los access rights de la Land Reform (Scotland) Act 2003, el «derecho a vagar» escocés— NO alcanza al vehículo a motor. El art. 9(f) de esa misma ley excluye del derecho de acceso «being on or crossing land in or with a motorised vehicle or vessel (other than a vehicle or vessel which has been constructed or adapted for use by a person who has a disability and which is being used by such a person)». Por eso la acampada libre escocesa, que sí ampara a una tienda de campaña, NO ampara a una autocaravana, una camper ni una caravana remolcada.
- El único resquicio del art. 9(f) es el vehículo construido o adaptado para una persona con discapacidad y usado por ella: ese sí conserva el derecho de acceso y, con él, la excepción del art. 3(2).
- La excepción de las 15 yardas del Road Traffic Act 1988, s. 34(3), induce a falsa seguridad: sólo exime del delito de tráfico de conducir fuera de la calzada cuando se hace con el único fin de aparcar el vehículo, y de nada más. No confiere derecho alguno sobre el terreno, no exime del art. 3 de la Trespass (Scotland) Act 1865, ni del trespass civil, ni del cumplimiento de una byelaw local (por ejemplo, las Camping Management Byelaws del parque nacional de Loch Lomond and The Trossachs). Su texto no obra en el expediente: se enuncia como advertencia, no como cita verificada.
