Sleeping in a motorhome in Ireland

The three legal facts are distinct: parking, sleeping inside and camping. The mistake that costs money is assuming that the second follows from the first.

IT DEPENDS — No general time limit under national law. There is a limit only where there is a sign: RUS 018 (Restricted Parking) imposes the time shown on the plate, and after removing the vehicle it may not be parked again in the same place within 1 hour (art. 37(2)). In a zone with a prohibition for large vehicles, loading/unloading may not exceed 30 minutes (art. 38(1)(b)).
  • There is no national threshold based on length or on 3,500 kg; the limit for large vehicles is set by SIGN. Art. 38(1)(a): where sign RUS 019 is displayed with an information plate bearing a large-vehicle symbol, a vehicle whose maximum design gross vehicle weight (following the substitution made by reg. 16(o) of S.I. 332/2012, which previously read 'unladen weight') exceeds the figure shown on the plate may not park. In addition, art. 36(2): parking is prohibited on the footway, grass margin or central reservation (letter i), within 5 m of a junction (c), obstructing entrances (g), or in a way that interferes with traffic (k). CRITICAL POINT: parking correctly does not make sleeping lawful. On a public road the Roads Act 1993 s.69 applies (temporary dwelling = "any tent, caravan, mobile home, vehicle...used for human habitation"); off the public road the Criminal Justice (Public Order) Act 1994 Part IIA ss.19A-19H applies (s.19B expressly excludes public roads), with a fine of up to EUR 4,000 and/or 1 month's imprisonment (s.19G) and a power for the Garda to remove and store the vehicle (s.19F).
