Where the line lies between parking, sleeping and camping

Camping is forbidden outside a campsite or designated zone. What changes from one country to another is which gesture crosses the line:
- Lo que castiga la norma es acampar SIN el consentimiento del propietario o del ocupante legal: «without the consent and permission of the owner or legal occupier». Con permiso del dueño no hay delito. Es una prohibición por defecto, no absoluta.
- No hay franja de vía pública que salve: el art. 3(1) castiga acampar tanto «on any land, being private property» como «on or near any road», y en ambos casos exige el consentimiento del titular.
- La excepción del art. 3(2) —quedar amparado por los access rights de la Land Reform (Scotland) Act 2003, el «derecho a vagar» escocés— NO alcanza al vehículo a motor. El art. 9(f) de esa misma ley excluye del derecho de acceso «being on or crossing land in or with a motorised vehicle or vessel (other than a vehicle or vessel which has been constructed or adapted for use by a person who has a disability and which is being used by such a person)». Por eso la acampada libre escocesa, que sí ampara a una tienda de campaña, NO ampara a una autocaravana, una camper ni una caravana remolcada.
- El único resquicio del art. 9(f) es el vehículo construido o adaptado para una persona con discapacidad y usado por ella: ese sí conserva el derecho de acceso y, con él, la excepción del art. 3(2).
- La excepción de las 15 yardas del Road Traffic Act 1988, s. 34(3), induce a falsa seguridad: sólo exime del delito de tráfico de conducir fuera de la calzada cuando se hace con el único fin de aparcar el vehículo, y de nada más. No confiere derecho alguno sobre el terreno, no exime del art. 3 de la Trespass (Scotland) Act 1865, ni del trespass civil, ni del cumplimiento de una byelaw local (por ejemplo, las Camping Management Byelaws del parque nacional de Loch Lomond and The Trossachs). Su texto no obra en el expediente: se enuncia como advertencia, no como cita verificada.
