Onverminderd het bepaalde in artikel 1:8 kan de ontheffing worden geweigerd in het belang van de bescherming van: natuur en landschap; of een stadsgezicht. 5. Op de ontheffing is paragraaf 4.1.3.3 van de Algemene wet bestuursrecht (positieve fictieve beschikking bij niet tijdig beslissen) niet van toepassing.»
